IP Policy - Trademark and Copyright

 

1. Open Source License

2. MOSIP Trademark

A trademark provides the owner with an exclusive right to authorize or control the use of the mark. Trademarks exist to serve users by providing information about the origins of a product or service. Therefore, projects that open source their copyrights over code still enforce their trademarks in order to make it clear to the users of their project about the source and origin of the code, documentation and other output.

IIIT-B asserts its right over the trademark MOSIP® and the visual logo in order to reliably indicate to users the products that have been created under the aegis of the MOSIP project. It also does not intend to create undue restrictions on discussion or collaboration on MOSIP through its trademark policies. 

The International Institute of Information Technology, Bangalore (IIIT-B) has registered MOSIP® as a trademark in India and other countries. Please use ® with the first mention of MOSIP in all materials. 

In addition, IIIT-B has registered a visual MOSIP logo trademark in use. Please comply with the visual guidelines below in the usage of the MOSIP Logo.

 

2.1 Trademark Usage Guidelines

Your right to use the MOSIP trademark is provided for in this policy and in the statement of permitted use displayed on the https://mosip.io website.  It is independent of your use of the MOSIP Codebase, which is solely governed by the MPL 2.0 license. 

Do’s

  • A trademark notice ®  should be used on the most prominent and/or first appearance of each MOSIP trademark.
  • Fair use of the MOSIP trademark is permitted, including making factual statements about MOSIP. You are not permitted to use the MOSIP trademark in false or misleading materials or statements.
  • You are permitted to use the official version of the MOSIP logo or trademark on your webpages as a reference or link as long as the usage is relevant.

Don’ts:

  • The trademark should not be used as your product or domain name, logo or design, or as any part thereof.
  • The MOSIP trademark should not be altered in any way. It should not be combined with any other mark, abbreviated or partially displayed. 
  • The trademark should not be used in your product’s commercial advertising or promotional material without the express permission of the MOSIP project. 
  • Do not state or imply that the owners of the MOSIP trademark endorses, certifies or supports your company, products, or services, without the express permission of the MOSIP project.
  • Do not attempt to claim or assert any ownership rights, or to register in the MOSIP trademark. 
  • The MOSIP logo should not be displayed with color variations, or with other elements superimposed on top of the logo.
  • All press releases that use the MOSIP trademark are required to be passed by the MOSIP team by contacting info@mosip.io

2.3 Disclaimer

IIIT-B does not make any express or implied warranties, including but not limited to the warranties of non-infringement of any third party intellectual property rights.  IIIT-B shall not be liable for any claims relating to user’s activities falling within the scope of the permission and user hereby agrees to indemnify, defend and hold IIIT-B and contributors to the MOSIP project harmless against any such claims.

 

2.4 Updates

The MOSIP project may release new versions of this trademark policy or statements of permitted use of its trademarks without notice.

3. Creative Commons

Other than code, all works put out by the MOSIP project are governed by a Creative Commons Attribution-ShareAlike 4.0 International License, unless expressly indicated otherwise.

This means that you are free to copy and redistribute our material, and adapt or transform it, even for commercial purposes, as long as you:

  • Attribute our work, and 

  • Distribute your adapted work under the same license, without placing additional restrictions.
